Tonga

National jurisdiction · as of 2026-09-05

Tonga has no adult-content age-verification law, social-media minor-access restriction, app-store age-verification requirement, or age-appropriate design code.

Section 115A of the Criminal Offences Act [Cap 18] makes it an offence to publish, produce, or possess child pornography, carrying a fine of up to $100,000 or imprisonment of up to 10 years, and separately states that child pornography is prohibited; the Pornography Control Act 2002 separately prohibits the production of pornographic material in general (s. 4) and its sale or hire (s. 5).

None of these provisions imposes an age-verification or age-gating duty on a service provider; each runs to the person who creates, produces, sells, or hires the prohibited material, not to a platform that must verify a user's age before granting access to adult content. The Family Protection Act 2013 (Act No. 19 of 2013) protects family members, including children, from domestic violence and does not address an online service.

What is stated here about the Criminal Offences Act and the Pornography Control Act rests on a 2014 submission by Tonga's Solicitor-General (Attorney General's Office) to the US Department of Labor describing these sections, rather than on the statutes' own words.
